Resumen: El presente trabajo de investigación tuvo por objetivo general determinar la
incorporación de la naturaleza jurídica del compromiso de contratar como acto
inscribible, para otorgar oponibilidad frente a terceros; se postuló como hipótesis
general que, la incorporación de la naturaleza jurídica del compromiso de contratar
como acto inscribible, brinda oponibilidad frente a terceros, otorgando protección a
los intereses de las partes por la probabilidad de riesgo latente de inscripciones
posteriores; dentro del desarrollo de la investigación se analizó la teoría de la
inscripción registral del compromiso de contratar a través de su anotación preventiva.
La investigación fue cualitativa-documental, en mérito a la discusión de los resultados
que se realizó a través de la argumentación jurídica. Mi hipótesis fue validada, a
consecuencia de ello mi conclusión principal es que, se debe incorporar dentro del
artículo 2019 del Código Civil al compromiso de contratar, el cual posee la
característica de ser un contrato autónomo, así mismo, produce efectos de hacer
entre las partes, además que su carácter obligacional no es diferente al contrato
preparatorio de opción, por lo que, con la celebración del contrato definitivo surge su
oponibilidad frente a terceros, del mismo modo, mi recomendación fundamental está
dirigida al Congreso de la República, en el sentido de incorporar al inciso 2 del artículo
2019 del Código Civil que prescribe los Actos y Derechos materia de inscripción del
registro de propiedad inmueble, con la finalidad de incluir como contrato inscribible al
Compromiso de Contratar.
The general objective of this research work was to determine the incorporation of the legal nature of the commitment to contract as a registrable act, to grant enforceability against third parties; It was postulated as a general hypothesis that the incorporation of the legal nature of the commitment to contract as a registrable act provides enforceability against third parties, granting protection to the interests of the parties due to the probability of latent risk of subsequent registrations; Within the development of the research, the theory of registration of the commitment to contract was analyzed through its preventive annotation. The research was qualitative-documentary, due to the discussion of the results that was carried out through legal argumentation. My hypothesis was validated, as a result my main conclusion is that the commitment to contract must be incorporated into article 2019 of the Civil Code, which has the characteristic of being an autonomous contract, likewise, it produces effects of doing between the parties, in addition that its obligatory nature is not different from the preparatory contract of option, therefore, with the execution of the definitive contract its opposability against third parties arises, in the same way, my fundamental recommendation is addressed to the Congress of the Republic, in the sense of incorporating paragraph 2 of article 2019 of the Civil Code that prescribes the Acts and Rights subject to registration of the real estate registry, with the purpose of including the Commitment to Contract as a registrable contract.
