The purpose of the current study was to propose the change of article 20, paragraph 1 of the Peruvian Criminal Code due to the inadequate application of the figure of actio libera in causa in the treatment of unimputability, thus contributing to the preservation of legal security by not leaving unpunished the subject who, using his freedom of decision, voluntarily places himself in a defective state to damage a legally protected asset. To this end, it was necessary to analyse the current state of the figure of the actio libera in causa and the cases of exemption from criminal liability within our Peruvian criminal law, insofar as the existence of these exonerations have allowed the subject who manages an anti-juridical act to escape criminal sanction; The modification of article 20, paragraph 1 of the Peruvian Criminal Code in relation to the figure of the actio libera in causa, as currently the management and legal system does not apply an adequate application of this figure, which is why this proposal for modification was made. By virtue of this analysis, a formulation of the problem of study was made, carrying out a methodological study of a legal and social nature, with the aim of being able to impose a sanction on the subject who voluntarily places himself in a state of unimputability to carry out his criminal act, and not be deserving of a certain penalty for it.
