The extrajudicial possession defense is an exceptional mechanism to recover possession of both movable and immovable property, and is therefore established in article 920 of the Civil Code of 1984. However, due to the recent amendment made by the Law 30230 of July 12, 2014, brought with it the addition of four paragraphs, which has basically been highly criticized by specialists in civil matters. For this reason, we have dedicated ourselves exclusively to dealing with its first paragraph, which establishes a possession period of 15 days that begins to run from the date of knowledge. Therefore, the present work aims to argue reasons that will support its modification in Peru, thus using the collection of information from various theses, articles and books; which at the end of it, will allow the respective proposal of reasons that will make its particular modification possible.
