This article addresses a real problem in which the following legal question falls: why should civil courts restrict their actions in the face of electoral protection actions within the framework of electoral processes? After searching for the answer(s), the thesis topic is presented, the restriction of electoral protection before the ordinary jurisdiction in the framework of electoral processes. During the investigation through jurisprudence, it has been possible to observe the current situation of the protections in the electoral process, so the following hypothesis is formulated: if the electoral protection process is part of constitutional law, then in the electoral protection processes the ordinary jurisdiction must have restrictions on its review. The background, theoretical bases and conceptual categories were reviewed, and the theoretical framework of the topic was developed based on the specific objectives, making a comparison with other Latin American countries. Finally, it is concluded that the restriction of civil courts is based on the need to have specialized courts in electoral matters that guarantee impartiality, the protection of political rights and efficiency in the resolution of conflicts, which are the constitutional courts.
