This work gathers the information provided by our legislator in civil matters regarding the lease contract, specifically in those contracts where the termination of the same is discussed, generating a problem regarding the return of the property. In response to this, the 2017 National Civil Jurisdictional Plenum was held in the city of Chiclayo, which encompasses the core subject of research because in the aforementioned Plenum, a particular criterion is developed regarding the disassociation of the assumption of a precarious occupant, generated upon the conclusion of the lease contract, which would bring a "possible" solution regarding the judge who should hear the case so that the subjects of the process can shorten the time involved in the process without further delays due to procedural jurisdiction. However, instead of finding a solution to the controversial issues, a new topic of discussion and confusion is generated for the lessors, who are the most interested in having this type of contract regulated efficiently, since eviction lawsuits are the most unsuccessful because they require a long period of time and resources to recover the property. For this reason, with respect to eviction due to precarious occupation, the need arises to clarify the controversy generated between the literal and functional interpretation of the rule, having as a general objective to analyze the majority proposal adopted by the National Civil and Civil Procedural Jurisdictional Plenum - 2017 - Chiclayo.
