The present research aims to propose legislative modification of the penalties for disqualification for the crime of active bribery in the context of police functions, due to its temporality. In this context, a thorough analysis has been carried out, including the consideration of international regulations from countries such as Spain, Mexico, and Colombia, in order to make a comparison with our current legislation. As a result of this comparative analysis, it has been observed that this crime is punished with imprisonment and disqualification; however, the main characteristic of these sanctions is that they are determinate. This contrasts with our regulation, since disqualification presents the characteristic of indefinite temporality. From a doctrinal perspective, it is emphasized that the application of this type of penalty has legal consequences in the field of criminal law, as it indefinitely prevents the defendant from re-educating, rehabilitating, and reintegrating into society, these being considerations that refute the modification of disqualification penalties. Additionally, this proposal is supported through a specific judicial case, arguing that disqualification penalties for the crime in question do not meet the fundamental objectives and purposes of criminal law, such as rehabilitation, the principle of proportionality, among others. Consequently, the proposal would consist of a disqualification penalty with suspensive character, with the aim of achieving a regulation more in line with the principles of proportionality and rehabilitation established in our criminal legislation.
