This research raises the fundamental problem of analyzing the motivation of the civil reparation in the accusatory requests presented before the preparatory investigation courts (JIP) of Lamas, during the year 2021. To date, serious violations to the principle-right of the due motivation of judicial resolutions in the postulatory writs in the civil reparationare highlighted leading to the reason of this study.The general objective set is the assumption of knowing how civil claims are motivated in criminal proceedings in the jurisdiction of Lamas, understanding that both proceedings are autonomous from each other.To this end, a basic, non-experimental research design was validated, in which the documentary analysis technique was applied to a sample of 76 accusatory requests filed with the JIP during 2021.The main results showed that in the total of the sample universe, the prosecuting authorities have dedicated a specific section to civil reparations. However, in none of the 76 postulatory pleadings, the civil claim has been accompanied autonomously with its own means of proof, violating the provisions of the last paragraph of Fund. 29 of AP 04- 2019/CIJ-116.Likewise, it has been verified that the motivation of the civil reparation in the accusatory requests presented before the JIP of Lamas, 2021, present an insufficient motivation with a representation of 58%, followed by an apparent motivation in 42%.This means that the accusatory requirements at the end of the civil reparation in the province of Lamas, represent a clear breach of the principle- right to due motivation of judicial decisions, required by constitutional mandate, procedural rules and plenary agreements (AP 04-2009-CJ-116 and AP 04-2019-CJ-116).
