In our country, where the political constitution of Peru protects human rights, the fundamental rights state that in all processes the presumption of innocence must be respected, and as a general rule in a process is the appearance, being preventive detention the ultima ratio and only exceptionally. Currently, it seems that the opposite is occurring, the judges of guarantees, the judges in charge of ruling on preventive detention, issue resolutions as if the rule were preventive detention and the defendants are sent to a prison to await trial (Chauca, 2019, p. 14). The research approach is quantitative, since it operates in the field of physical-natural sciences, using the deductive method and statistical analysis. It is dedicated to collecting, processing and analyzing numerical data, according to previously established variables, so it takes into account the association or relationship between the variables that have been quantified (Valderrama, 2019, p. 117). The research presents a non-experimental design, since the variables under study will not be manipulated. It is concluded from the investigation that the requirements for pretrial detention are based on the aspects of evidentiary sufficiency, where pretrial detention is a precautionary measure, as well as on the existence of procedural danger and the need for precautionary measures to protect fundamental rights and rights related to equality of arms.
