The thesis entitled “Criteria determined by judges for penitentiary benefits to those convicted of robbery and principle of legality in Criminal Courts of Tarapoto, 2013 – 2018” is a basic study, with explanatory level, non-experimental design. The Sample consisted of 23 judicial files of requests for penitentiary benefits, with the Documentary Analysis Form as the instrument for the collection of field data. It is concluded that the criteria determined by judges for penitentiary benefits for those convicted of robbery and principle of legality in Tarapoto Criminal Courts, 2013-2018, are deficient, where the compliance values for the variable Penitentiary benefits is 72.9% and for the variable principle of legality of 16.0%, whereas the granting of the penitentiary benefit only occurs in 13.0% of the cases. The level of application of the principle of legality in prison benefits for those convicted of robbery in the Criminal Courts of Tarapoto, 2013-2018, are based on Law No. 30076, Law No. 30101, Law No. 30054 and Law No. 29604. This is complemented mainly by the jurisprudence of the Constitutional Court in STC N° 0148-2008/TC, STC N° 00012-2010-AI/TC Basis 80, Case N° 02700-2006-PHC/TC, and Plenary Agreement N° 08-2011/CJ-116.
