The general objective of this research was to determine how due process is affected by the reasonable time frame in the Preparatory Investigation Courts 2020 – 2021. Subsequently, the specific objectives were to determine the guarantees of due process in the affectation of the reasonable term in the Preparatory Investigation Courts 2020 - 2021, to identify the cases where the reasonable term and due process in criminal matters have been affected, and to determine the importance of due process and the criteria applied in the Preparatory Investigation Courts 2020 - 2021. The research was applied, with a quantitative approach, at a correlational level. The population and sample consisted of 47 files, in which the resolutions were detailed and analyzed. In addition, 16 surveys were applied, all of them directed to personnel working in the Preparatory Investigation Court of Tarapoto, using the collation guide and questionnaire techniques. Of the 47 files, 09 files show that the investigation is within the reasonable timeframe of the process, which represents 15% of the total. Therefore, according to the quantification of the Rho Spearman correlation, a high significance level of 92.7% has been obtained, indicating that due process is affected by the reasonable period of time, from the first proceedings of each specific case to the date on which the indictment control hearing was held. In conclusion, during the course of the proceedings, the right to freedom of the accused would be violated and he would be subjected to a criminal proceeding that does not have the necessary guarantees to ensure the correct development of the process.
