The present research entitled “Declarations of the aspiring effective collaborator to support preventive prisons San Martin, 2021-2022”. Criminal law today is becoming a current trend in the arduous battle against organized crime, money laundering and corruption, in which the aspiring effective collaborator participates, based on his or her declaration. The general objective is to determine the use of the statements of the aspiring effective collaborator to support preventive imprisonment San Martín 2021-2022. The specific objectives are: To establish whether the principle-guarantee of the right to effective defense in the criminal process is affected and to analyze the statements of the aspiring effective collaborator to pass the proportionality test to serve as elements of conviction to support preventive imprisonment. The research design is basic qualitative, using surveys and interviews. From which the following conclusions were drawn: there is an improper use of the declarations made by the aspiring effective collaborator, since the majority of those surveyed indicated that they totally agree, given that this type of declaration is not being used correctly with respect to the aspiring effective collaborator, therefore, what is occurring should be carefully reviewed. It is also concluded that the statements of the aspiring effective collaborator in the sense that they are not passing the filter of the proportionality test to serve as an element of conviction to support preventive imprisonment are not being developed correctly, since, of the 100% of the interviews carried out, a total of 80% indicated that they are not passing the corresponding filter. Finally, it was concluded that this very important figure of the aspiring effective collaborator is being misused, both in terms of his participation and as elements of conviction in preventive prisons at the time of support, which is often a problem that should be observed. Consequently, a better and more effective solution should be found, based on criteria that should be implemented.
