In this professional sufficiency work, the analysis of the sentence by the Constitutional Court (from now on, Court or CC) on the constitutional protection (Amparo) appeal filed in EXP. 02414-2022-PA/TC will be taken as the basis. The appeal requests the inapplicability of section 2 of Article 62 of Legislative Decree 1071, within the framework of the annulment proceeding filed against the arbitral award dated January 20, 2020, issued in Arbitral Case 0308-2018-CL. In this context, despite the Court declaring the amparo claim INADMISSIBLE, there are singular votes in which certain justices diverged from various grounds contained in the majority opinion. Furthermore, this work focuses on the constitutional control of arbitral awards and the balance between arbitration autonomy and judicial control for effective procedural protection, based on judgment 02414-2022-PA/TC and its singular votes regarding diffuse control and appeals filed against an arbitral award; through legal sources and binding precedents that develop different positions. The conclusion emphasizes the importance of optimizing and extending constitutional control over the autonomy of arbitration and judicial oversight, highlighting the need for further analysis for future disputes.
