This research aims to analyze the ruling issued in File No. 00002-2021-PI/TC by the Constitutional Court, specifically regarding the constitutionality of Article 248, paragraph 4 of the General Administrative Procedure Law, which includes the principle of typification. The case concerns a lawsuit for unconstitutionality filed by the Bar Association of Ica, addressing various legal provisions related to procurement processes, public bidding, and the rules concerning the punitive power of public administration. The principle of typification outlined in the aforementioned article is particularly emphasized, with the argument that its wording could allow for the regulation of offenses, thus violating both the principles of legality and typification. Specifically, the lawsuit seeks to question whether the cited provision contradicts Article 2, paragraph 24, literal d) of the Political Constitution of Peru, particularly regarding the right not to be sanctioned for an offense that is not strictly and specifically defined by law. Finally, this research concludes that this aspect of the lawsuit should have been upheld, as the contested article allows for the creation of offenses through regulations, which infringes upon the guarantees upheld by the principles of legality and typification
