The present work analyzes the Ugarteche case in relation to same-sex marriage in Peru, based on Constitutional Court ruling 676-2020. This case challenges an administrative regulation deemed harmful to fundamental rights, highlighting the importance of applying the principles of proportionality and reasonableness in legislation. Through a jurisprudential analysis, the rights of equality within the context of same-sex marriage are examined. The Constitutional Court ruling emphasizes that laws must align with constitutional principles, ensuring the protection of fundamental rights. This analysis is supported by academic and legal sources to understand the legal implications of the ruling and its impact on the regulation of marriage in Peru. From our perspective, we defend the right of every person not to be discriminated against based on their sexual orientation. While recognizing Peru’s religious traditions, we stress that civil marriage is a contract regulated by law, not by religious doctrines. The Peruvian legal framework, as the highest-ranking norm, protects marriage without specifying that it must be between a man and a woman. Under Article 2 of the Peruvian Constitution, which establishes equality before the law, civil marriage should be understood as an equal right for all
