The main objective of this investigation was to determine why the crime of abortion defined in subsection 1 of article 120 of the Penal Code, when the pregnancy is a consequence of rape outside of marriage, affects the right to mental health of the victim, in Peru. To meet the stated objective, a sample made up of 10 sentences issued in the 2018-2020 period in cases of the crime of abortion and 10 by 03 statistical reports on sexual violations resulting in pregnancy in the 2015-2021 period was considered; 03 Psychology graduates from Trujillo, to obtain their specialized opinions on the effects on the mental health of rape victims; by 42 criminal lawyers from Trujillo – La Libertad, to gather their opinions on the decriminalization of abortion in Peru; and for comparative law on abortion and the right to abortion in Latin America. Intentional non-probabilistic sampling was used in the selection of the documentary sample, and random probabilistic sampling for the selection of the personal sample, considering the criteria of specialty, qualification, litigation and place of professional practice, complemented with the legislation and related doctrine. with the study variables. The techniques used to collect information from the study sample were documentary analysis, survey and interview, with their respective data collection instruments. Likewise, the methods used for the discussion of the results were: the inductive, deductive, analytical, synthetic and hermeneutical method. Finally, the following conclusion was reached: It has been verified that the crime of abortion defined in article 120°.1 of the Penal Code affects the mental health of pregnant victims of rape, because they are subjected to a life of stigma and suffering and pressured to maintain an unwanted pregnancy, which even leads them to undergo a clandestine abortion that in many cases causes death.
