This paper analyzed the binding precedent issued by the Specialized Chamber for the Elimination of Bureaucratic Barriers of Indecopi (hereinafter, the SEL), which, following an interpretation of the rules responsible for establishing the precepts for the publication of regulations, established general guidelines to determine the validity and effectiveness of the provisions issued by public entities. In this regard, the legal framework that regulates the publication of general regulations and Single Texts of Administrative Procedures (TUPA) issued by public administration entities was reviewed, with the aim of determining the importance of the administrative precedent and its impact on procedures for eliminating bureaucratic barriers. In this sense, it was possible to observe that the issuance of the binding precedent issued by the SEL reiterates concepts and guidelines already established in the regulations on the publication and validity of regulations, neglecting one of the main characteristics of an administrative precedent, such as the interpretation of positive rules for their subsequent application in particular cases. In this way, it is concluded that the precedent issued does not provide new ideas or criteria to the existing regulations and does not fulfill its objective of providing clarity and predictability to the standards publication system, in addition to the fact that it has not been possible to notice an economic impact on society, through the system of eliminating bureaucratic barriers.
