The objective of this work is to carry out an analysis of Resolution N° 004442-2023/JUS-TTAIP-Second Chamber, issued in File 004442-2023/JUS-TTAIP, issued by the Court of Transparency and Access to Public Information (TTAIP), which declares founded the appeal presented by Mr. Asunción Chávez Aguilar against Educational Institution N° 80040 Divino Maestro - La Esperanza - Trujillo, through which a precedent of mandatory observance on the quality of public information was established of the attendance control record of officials and public servants. Within the analysis, the aforementioned Resolution will be analyzed, based on the decision adopted by the TTAIP, the singular vote cast, as well as the legal bases necessary to reach said decision. Likewise, we will address issues related to transparency in Public Administration, the right of access to public information, the exceptions contemplated in the Law, and the protection mechanisms for access to public information. For this research, different sources have been used, such as: bibliography related to national and international authors, jurisprudence of the Constitutional Court, as well as legislation applicable to the matter. In summary, the authors come to the conclusion that the attendance control record of officials and public servants is public in nature, in order to meet the objective of materializing the transparency that constitutes a fundamental pillar for oversight by the apparatus of the state and society.
