The purpose of this paper is to analyze the Judgment issued in Case No. 00009-2020-PI/TC, which declares unfounded the unconstitutionality lawsuit filed by the College of Psychologists of Peru against the Congress of the Republic of Peru, in relation to Law No. 30947, the Mental Health Law, due to the alleged violation of the right to mental health, regarding the protection of people suffering from mental health problems, and the right to work of psychologists. The analysis will review both the majority decision and the dissenting opinion of the judgment, along with the grounds that supported the ruling. Articles, bibliographic sources, and instruments from international human rights organizations have been consulted to broaden the understanding of how mental health is treated within the framework of human rights. Furthermore, we will highlight the need to protect fundamental rights in the field of mental health, considering the application of recommendations from international organizations to be crucial, given that mental health is essential to human well-being and its protection lies at the core of human rights. In this sense, it is necessary for the Peruvian State to align itself with international human rights commitments and the recommendations of international organizations in the development of public policies. Therefore, we propose the amendment of Law No. 30947 in order to guarantee the right to mental health.
