The present work has been carried out in reference to the Plenary Judgment No. 178/2024 Junín, issued by the Constitutional Court, in which the judges unanimously voted three (03) votes, in relation to the constitutional grievance caused by the violation of the right to disability pension in accordance with Law No. 26790 and its complementary and related rules. In this context, the controversy caused by the accreditation of the occupational diseases of pneumoconiosis and hypoacusis is developed. Likewise, it is essential to mention that it is necessary to have the pertinent training and accreditation of pulmonologist physicians, with the purpose of equitable access to health services, as in the mentioned case. Thus, it is essential to have Medical Commissions for the Qualification of Impairment due to Occupational Diseases at the national level because they are the ones who accredit occupational diseases, as this will be presented as evidence demonstrating the causal link between the injured person and the activities performed. The evaluation of the conceptual framework and the legal consequences of the evidential means that prove the occupational disease to establish the causal link between the mining employee and the work performed in the mine. Thus, it will be carried out taking into consideration the national and international jurisprudence and doctrine; to determine the cause-effect relationship between the work activities and the disease.
