This work has been prepared under the analysis of the Administrative Resolution No. 1830-2023/SPC-INDECOPI, which contains legal relevance because it revolves around the violation of consumer rights within a consumer relationship, because through statements on social networks the company One Entertainment S.A.C limited the right to a refund of money to consumers who purchased their tickets to the “Guns N' Roses” concert. In this sense, it is important to analyze whether the provision issued in the communications of One Entertainment S.A.C should be considered as a consumer contract by adhesion or a unilateral decision by the company, which would be classified as a violation of the duty of suitability. For this reason, we have verified doctrinal criteria, the legal provisions and/or current regulations for consumer protection and defense issued by the National Institute for the Defense of Competition and Intellectual Property, which allow us to define the concepts and fundamental characteristics of the points to discuss the issue in controversy. As a duo, we were able to conclude that although the statement issued by the company generates a limitation on consumer rights, it does not meet the characteristics to be considered a contract by adhesion; on the contrary, said communication turns out to be a unilateral provision, evidencing a breach of the duty of suitability on the part of the supplier by conditioning the return of the money through a statement on social networks.
