The legal subject matter of the case relapsed in the Plenary of the Judgment 1/2022 relapsed in Case N°03432-2018-PA/TC converges on labor, social security and constitutional matters and resolves the amparo lawsuit filed by F.N.G.R. against the Judgment issued by the Fourth Civil Chamber of the Superior Court of Justice of Lima, dated June 20, 2018, which declared unfounded the claim for restitution of severance pension as stipulated in Decree Law N°20530 against the General Secretariat of the Ministry of Economy and Finance. The main basis of the plaintiff is that he has the quality of severance pension for teaching and there is no incompatibility to simultaneously receive income for having reentered the Judiciary under a CAS contract as established in Article 8° of Decree Law N°20530. For this reason, the present work of professional sufficiency is focused on an analysis of the legal figure of the compatibility of simultaneous income perception, being these the remuneration and the pension, dealing, within it, with issues of doctrinal quality regarding the right to pension and social security. The provisions of the aforementioned Plenum have an impact mainly on pension matters; however, the analysis of the same and its subsequent application in different cases may generate a wide range of results in favor of the workers in Peru, complementing their quality of life and the great social impact that it would have.
