The objective of this research is to analyze the framework of civil liability in the context of genetic damage, evaluating the compensation criteria and its practical application to contribute to the development of a more fair and effective system. A basic methodology with a qualitative approach was used and its main results were that these deficiencies limit the effectiveness of the legal system to adequately protect victims of genetic damage. One of the most notable deficiencies identified in the analysis is the lack of clarity in determining the causal relationship between the conduct of the alleged perpetrator and the genetic damage suffered by the victim. This is due, in part, to existing legal gaps in national regulations, which do not clearly and specifically establish how to address cases of medical malpractice related to genetic damage. It is concluded that the results of the research show that the current framework of civil liability in the context of genetic damage presents significant deficiencies in the determination of the causal relationship, the quantification of the damage and access to justice. These deficiencies represent limitations to guarantee effective protection for victims of genetic damage.
