The present research was based on the problem: Is the enforceability of the written evidence in the evidentiary means difficult for the judicial recognition of a common-law marriage, due to the excessive evidentiary standard to prove the status of cohabitants of a couple? The main objective of this research was: To determine if the enforceability of the written evidence in the evidentiary means is difficult for the judicial recognition of a common-law marriage, due to the excessive evidentiary standard to prove the status of cohabitants of a couple. The technique used was the survey and the instrument was the questionnaire. The population consisted of the trial lawyers of the Loreto Bar Association, and the sample consisted of 40 lawyers of the Loreto Bar Association. The design used in this research is the "non-experimental transactional or transversal type of descriptive level". For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: The requirement of written evidence in the means of proof does prove to be difficult for the judicial recognition of a common-law marriage. Therefore, it is proposed to modify the second paragraph of article 326 of the Civil Code by eliminating the expression "provided that there is a principle of written proof" for the judicial recognition of a de facto union in de facto union proceedings.
