The purpose of this investigation is to determine the violation of the fundamental right to work through the uncaused dismissal carried out by different companies or public institutions, leaving the worker completely abandoned from work without reason or motive, as is often demonstrated through a process judicial and that in most cases are won by the appellants. Our legal system in labor matters protects the worker from any abuse that the employer could commit to the detriment of his or her status as a worker and against unjustified, fraudulent dismissal. The legal standard recognizes that these types of dismissals are abusive and contravene the fundamental rights of employees people, This work will allow us to know the legal mechanisms that are used for unjustified dismissals. Our job is to determine whether these mechanisms are within the constitutional framework. Likewise, we will be able to observe how through our objectives we will be able to determine our conclusions and their research results that have a high degree of reliability. This research is of a basic nonexperimental descriptive type, that is, the study variables will not be modified, it is cross-sectional, the population and sample refers to 44 public sector workers, who helped us carry out our surveys.
