Delito de asociación ilícita para delinquir como organización criminal" recurso de nulidad 1802-2018

Abstract

El objetivo de la presente investigación es analizar el Recurso de Nulidad N. º 1802-2018/Lima, que permite conocer el tipo penal derogado de Asociación ilícita para delinquir, incorporando al delito vigente de Organización criminal. Optando así por un método de investigación descriptiva, que permite establecer un desarrollo jurídico, doctrinario y jurisprudencia!, permitiendo generar soluciones a vacíos o lagunas legales, que están expuestos en nuestra realidad. Por ello, se aplicó y ejecutó una tipo de metodología socio jurídica, que permitirán realizar el análisis de documentos y fichajes de materiales escrito, empleando así las variables, independiente y dependiente destinadas al delito de asociación ilícita para delinquir, y a su vez al delito de organización criminal. De modo que, el análisis del Recurso de Nulidad N.º 1802-2018/Lima, de nuestra muestra está relacionado al caso en mención, a fin de realizar una labor interpretativa y de análisis del contenido, por lo que, en este caso la población y la muestra serán los mismos, por tanto, será no probabilístico, meramente análisis documental. De tal forma, los resultados extraídos del recurso de nulidad citado en líneas anteriores, se conoce con mayor certeza como se presentaba el delito de asociación ilícita para actual, y como se presenta en la actualidad, mediante el tipo penal de organización criminal. Por ello, resultó necesario fijar la relación significativa entre el delito de asociación ilícita para delinquir y el vigente tipo penal de organización criminal, toda vez que para la aplicación y configuración de la norma vigente (Art. 317° del C.P), resulta necesario que copulativamente incurran los elementos señalados en el desarrollo del trabajo, tales como el número de sujeto, el tiempo en el que se desarrolla, entre otros elementos que resultan obligatorios para su configuración.

The objective of this investigation is to analyze the Nullity Appeal No. 1802-2018/Lima, which allows us to know the repealed criminal offense of Illegal Association to commit a crime, incorporating the current crime of Criminal Organization. Thus opting for a descriptive research method, which allows establishing a legal, doctrinal and jurisprudential development!, allowing for the generation of solutions to legal gaps or gaps, which are exposed in our reality. For this reason, a type of socio-legal methodology was applied and executed, which will allow the analysis of documents and recording of written materials, thus using the independent and dependent variables destined for the crime of illicit association to commit a crime, and in turn for the crime of criminal organization. So, the analysis of the Nullity Appeal No. 1802-2018/Lima, of our sample is related to the case in question, in order to carry out an interpretative task and analysis of the content, so, in this case the population and the sample will be the same, therefore, it will be non-probabilistic, merely documentary analysis. In this way, the results extracted from the annulment appeal cited in previous lines, we know with greater certainty how the crime of illicit association was presented for today, and how it is currently presented, through the criminal type of criminal organization. For this reason, it was necessary to establish the significant relationship between the crime of illicit association to commit a crime and the current criminal type of criminal organization, since for the application and configuration of the current norm (Art. 317 of the C.P.), it is necessary that copulatively incur the elements indicated in the development of the work, such as the subject number, the time in which it is developed, among other elements that are mandatory for its configuration.
