The general problem of this research is "How would an express regulation of the deliberate intention of non-compliance in the Crimes of Omission of Family Assistance influence an optimization of due process?" And the general objective is: "To evaluate how the express regulation of the deliberate intention of non-compliance in the crimes of omission to family assistance, would optimize due process at the time of criminally sanctioning the accused." The technique used was the survey and the instrument was the questionnaire. The sample consisted of 60 people, of which 15 were registered lawyers specializing in Criminal and Constitutional Law, 15 magistrates of different levels, specialized in Constitutional Law and 30 members of the citizenry who are in criminal proceedings for the Crime of Omission of Family Assistance, belonging to the Judicial District of Loreto, specifically the Province of Maynas. Likewise, the design used was non-experimental, descriptive, and correlational. Descriptive statistics were used to analyze the variables individually, and the non-parametric chi-square test (x2) was used to test the hypothesis. The information obtained showed that: "The express regulation of the deliberate intention of non-compliance as a subjective element in the crime of Omission of Family Assistance, would optimize the guarantee of due process by reinforcing a better application of the procedural guarantees of due motivation and impartiality, in the criminal process, at the time of sanctioning the accused."
