The market is always a changing scenario, where the interaction of consumer with supplier is of utmost relevance, the supplier provides goods and services directed by the demand of Consumers, who with their consumption decisions guide the market, making it become more competitive. It is because of this role that the consumer receives special protection, recognized at the Constitutional level, pointing to the information and suitability of products or services as the most important rights in a consumer relationship. In effect, the consumer must guide their consumption decisions based on the information provided to them, ensuring that it is easy to understand and truthful. In addition to this, the consumer expects there to be a correspondence between the information they receive and the product. or service that is finally delivered. In the case that we will comment on, we will analyze what refers to these two rights, right to information and suitability, regulated in the Consumer Protection and Defense Code, commenting on the dissimilar pronouncements that the commission and court have had.
