The present report deals with dossier 547-2016, an executive process in which the executor BBVA Banco Continental requested payment of a promissory note debt of 215,877.06 soles, against Minera Zeus SAC company as obligated and J.M.G.M. and D.M.D.S. as guarantors. The executed company filed a contradiction, alleging falsity of the title, defenses derived from personal relationships with the executor and abusive use of right. In the first instance, the Second Civil Law Court of the Superior Court of Ancash rejected the contradiction and ordered execution, since the promissory note complied with the required formalities and its completion was contemplated in accordance with the Refinancing Contract signed between the parties. On appeal, the Transitory Civil Chamber of the Superior Court of Justice of Ancash revoked the final order, since, using ex officio evidence and the Iura Novit Curia, it determined that the established amount did not correspond to the debt, configuring a formal nulity. Finally, the Transitory Civil Chamber of the Supreme Court reversed the resolution of the second instance and confirmed the final order of the first instance, as it considered an error in the interpretation of article 690-D, paragraph 2, of the Civil Procedure Code, as well as an error in the application of the Iura Novit Curia principle (article VII of the Preliminary Title of the Civil Code).
