This research project's primary goal is to suggest a regulatory project that governs the release, exemption, or redemption of the status of suppliers disqualified from contracting with the State. This regulation would be achieved through compliance programs, aiming to enhance the efficiency of State contracts. According to the report of sanctioning resolutions issued by the State Contracting Court between 2021 and 2023, approximately 29% of resolved cases involved suppliers who submitted false or inaccurate documentation to various entities, including the State Contracting Court, the National Registry of Suppliers, and the State Procurement Supervisory Body. Additionally, an analysis of sixty (60) resolutions from the State Contracting Court during the same period revealed that sanctions imposed on suppliers have significant economic implications. Sectors such as health, education, and communications are particularly affected by these sanctions. Considering these findings, this research emphasizes the need to regulate compliance programs in public procurement. By doing so, suppliers disqualified from contracting with the State could potentially be liberated from their disqualification status. The proposed approach draws inspiration from the OECD’s recommendations and comparative legislation, ultimately aiming to improve the outcomes of contracting activities carried out by public entities.
