The protection of the right to live in a healthy environment began in the seventies, with the entry into force of international instruments. Those, when received by the States wich integrate the International Human Rights System, generated the production of domestic legislation focused on the protection of the environment. In Peru, the environment is protected by administrative and criminal processes. For the latter one, blank criminal types have been established in the Penal Code. The blank penal law allows the remission to environmental legislation like the Law of the Environment, which establishes the obligation to send Informes Fundamentados1 in criminal processes for environmental crimes. The Informe Fundamentado is a documentary evidence prepared and submitted by Environmental Enforcement Entities such the Agency for Environmental Assessment and Enforcement (OEFA, by its acronym in Spanish), which must be sent to the Public Ministry in order to assist in the investigation and prosecution of the crime. However, from the interviews conducted with specialists in the subject and from what was investigated, it is evidenced that the OEFA’s Informe Fundamentado lacks sufficient information to demonstrate the unfulfilled obligations and the existence of environmental damage. Therefore, in practice, the shortcomings of this document limit the effectiveness of the criminal prosecution.
