The present work of professional sufficiency is based on the analysis of the Judgment issued by the Constitutional Court in the context of what was debated in File 00677-2016-PA/TC, which deals with a claim for protection in which it is intended that the null dismissal of which the appellant would have been a victim is annulled. Although the majority vote concluded in declaring the claim FOUNDED, consequently VOID the dismissal, ORDERING the reinstatement of the plaintiff, there were also singular votes in an opinion divergent from what was resolved by the majority vote, as well as grounds for vote expanding criteria on the matter. Likewise, this sufficiency work has focused on labor discrimination against pregnant women in Peru and the viability of protection as a protection measure. Legal sources such as Laws Nos. 26513, 30367 and 31152 were examined, along with the contribution of labor law experts such as Soler Martín, Higa García and Sierra Hernáiz. The conclusion highlighted persistent gender discrimination based on biological and reproductive differences, underscoring the need to establish specific constitutional protection to ensure equal employment opportunities; this based on the urgency of protection. Finally, the regulatory absence being evident regarding the proof of notification of the state of pregnancy to the employer, this document has proposed alternative solutions in this regard.
