This investigation analyzes and compares the fulfillment of preventive obligations of safety and occupational health in mining and offers opportunities for improvement, in particular, on the induction and basic orientation, the application of management tools and the management of occupational examinations. The efficiency of the law and its compliance are exposed, as well as the improvement proposal to optimize the legislation and its compliance, somehow, it generates a greater efficiency in the actors of the mining sector, having a positive impact on its productivity and at a macro level improving the competitiveness at country level Likewise, a theoretical framework of the current legislation is developed, the compilation and analysis of official statistics on occupational safety and health, evidencing the relation of compliance with the law with its effectiveness, the extrapolation of the Peruvian case and purchasing it with other related countries and similar that stand out in the global mining sector. For the authors, a problem lies in the inadequate assignment of responsibilities to the mining owner, which generates an isolationist mechanism, discouraging the management of shared information, which could manage such centralized information, always under adequate supervision by the State. In another sense, it is necessary to standardize its form, content and application so that they are applicable in a unique way to all mine owners, workers and stakeholders in the sector
