The mining concession, according to our legislation, is expressly separated from the property in which it is located. The concessionaire's attributions do not contemplate any real right over the land in which the concession is extended. For this reason, the concessionaire must sign civil contracts with the owners of the property where the mining activities will be carried out. However, civil contracts do not constitute adequate documents for the purpose intended. Therefore, the concessionaire is exposed to claims that can be highly contingent, either due to the possible nullity of the agreements or requests for greater benefits than previously agreed. Similarly, in a country where land registration generally has incomplete information, the registration of civil contracts used is usually not possible, does not allow agreements to be endowed with the registration advertising required by a large-scale project. The mining legislation does not offer any solution either. Sectoral regulations only refer to the legal and business issues of the concession itself, away from matters related to the property where it is located. The proposal developed in this work is to contemplate in the mining legislation, the signing of an appropriate legal instrument that allows the free and adequate exercise of the faculties recognized by the State through the concession, and that reduces the probability of risks such as questioning of contractual validity or breach of agreements previously reached by the parties.
