The present investigation is based on the observation of the management and therefore on the administrative procedures carried out in the decision-making process by the State Agency for the Administration of Hydrological Resources (ANA). Our main objective is to identify the factors that hinder the adequate management of decision-making at the time of management. We have also identified that the principles and guarantees established in the Constitution are not effectively applied through national and international norms at the time of executing the management of water resources and decision-making, thus violating the adequate use of the right to water, which is a fundamental right that is found in the line of human rights. In the development of the work, we were able to see what kind of actions were taken by ANA to make decisions regarding the campesino communities of Carolina. These decisions were taken without observing the appropriate technical and management instruments and without applying the norms and constitutional principles regarding the beneficial use and distribution of water resources in the area, which led to the current dispute or conflict over access to water between the JASS of Carolina and the Asociacion Virgen de Consevidayoc. This was pronounced through an administrative resolution, that lacked the guarantee of motivation and did nothing more than generate a social conflict in the area; and thus generating damage or irreversible threat to the satisfaction of the water resource; such as the decrease in its use. It is necessary to pay attention to the problem of the bad application of the management of water resources for productive and population use, which could generate more conflicts; if we do not make a conscious and urgent effort to elaborate updated catalogs of the water zones and their behavior that coincide at the moment of the technical visit between the cadastral plans and the stored data. We also note that there is an urgent need for constant coordination between the members of the water system and for better management at the time of distribution and authorization of water licenses.
