The following research, titled "The Determination of Recidivism and Proper Motivation of the Prosecution: Cases from the First Office of the Second Provincial Corporate Criminal Prosecutor's Office of Cusco," aims to investigate whether the current regulations are sufficient to adequately motivate the prosecution's requirements when determining the condition of recidivism in the 1D-2FPPCC. This research was developed under a qualitative research approach., with a dogmatic and descriptive focus. The primary unit of analysis consisted of the prosecution requirements issued by the 1D-2FPPCC, pecifically when determining repeat offender status; The techniques used were documentary analysis and tabulation. The conclusion is that article 46-B lacks clear and specific guidelines, therefore the accusation requirements would not be duly motivated since each prosecutor maintains his own criteria when determining the status of a repeat offender; This fact has been corroborated with the analysis of the tax accusation requirements and the surveys carried out with the Prosecutors of the1D-2FPPCC, which have reflected the existence of a regulatory deficiency which is reflected in the accusatory requirements since there is no uniformity of criteria when determining the status of repeat offender of the accused being prosecuted, also replicating the impact on legal security..
