The objective of this thesis report is to determine the violation of the rights of defense, presumption of innocence and due process by dictating protection measures in an unmotivated manner in family violence processes. The dictation of these measures in an unmotivated manner has opened a debate among the operators of the law, among whom one party considers that the protection of the family and of women must be guaranteed and safeguarded in light of Law No. 30346. that another current considers that fundamental rights are being violated for the alleged victim, by omitting his right to defense and violating his presumption of innocence, affecting due process. In the information gathering stage for the preparation of the chapters of the theoretical framework, reference sources such as books, legal journals, national and international legislation, as well as national registry jurisprudence were used. In conclusion, it was determined that a legislative reformulation of Law No. 30346 is necessary, since it obviously affects the rights that are the subject of this thesis.
