The objective of this work is to analyze the case of Ana Milagros Estrada Ugarte, focusing on aspects related to the fundamental right to life, euthanasia and dignified death. When carrying out this analysis, we focus on the criteria and principles such as the measures that could be exhausted to achieve the legality of euthanasia with respect to Ana Estrada, who requires a death in dignified conditions, since she has suffered from a degenerative disease since she was 12 years old. which causes great suffering and physical deterioration. Her decision to obtain a dignified death, when she herself decides, has made her the first symbol of euthanasia in Peru. To carry out this report, information has been collected from academic journals specialized in jurisprudence, international theses on euthanasia, books written by national and international authors that address issues of fundamental rights, as well as the Political Constitution of Peru of 1993 and the Penal Code. Peruvian. As a result of this analysis, the conclusion is reached that assistance in the dying process should be regulated within the Peruvian legal framework, with the purpose of preserving the dignity of life, respecting the capacity of people to make decisions about their own life and recognize the right to a dignified death. Furthermore, it is proposed that the application of article 112 of the Penal Code be reconsidered, taking the case of Mrs. Estrada as a reference, with the aim of decriminalizing euthanasia in Peru.
