This investigation has the general purpose of providing a proposal for the quantification of personal injury, that allows judges to justify the amount of compensation awarded. The method employed is a case study for which we have conducted an analysis of the total of judicial sentences issued in the processes initiated against a company of the industrial sector in a period of five years. This has allowed us to determine the diversity of criteria and forms of quantification of the damage, evidencing that the lack of mechanisms and criteria generalized for the quantification affects the due motivation of judicial resolutions, the right to due process, the legal security and the predictability of judicial resolutions. As a first conclusion, we can indicate that, for our legal system, the implementation of a scale is necessary, that is, a calculation chart that includes among its criteria: age, degree of affectation differentiated by organ, and the affected functionality of the person. This will allow to grant uniform values to the objective criteria applicable, and that the sentences can grant a similar compensation for similar cases. As a second conclusion, we can affirm that the implementation of a scale will require an additional procedure for exceptional cases, that allows judges to diverge from the assessed quantification. For the deviation to not be arbitrary, we consider it necessary to establish as a limit the increase or decrease of 25%, and that, additionally, the deviation from the assessed quantification by the scale is considered a cause for cassation.
