In this paper a critical analysis is made on the case N° 05986-2015-PA/TC, by which Mr. G.A.J., files a constitutional grievance appeal against the resolution dated 02/25/2015 issued by the Civil, Labor and Family Vacation Chamber of the Superior Court of Justice of North Lima, for considering that his right to due process has been violated in the sanctioning administrative procedure initiated against him by the National Police of Peru, in addition to pointing out in parallel the violation of the prior and detailed communication of the notification that initiated said administrative process and his right to defense. Consequently, our subject of evaluation has been, on the one hand, to observe the alleged existence of a violation of the protected legal right and, on the other hand, to evaluate the different suitable ways applicable for the development and admission of the claim. Likewise, we point out that the sources consulted for the present work have been the national and international regulations as well as some books and academic journals for the contribution of relevant concepts related to the case. In this sense, it has been possible to conclude that, in principle, the lawsuit could have been declared inadmissible due to the existence of another suitable means such as the contentious-administrative process, in addition to analyzing the merits of the case and agreeing with the opinion of the Constitutional Court in declaring it well-founded.
