Abstract: El presente trabajo expone la sentencia del expediente Nro. 0510-2001-AA/TC, mediante la cual, el Tribunal Constitucional se pronuncia sobre la demanda de amparo interpuesta por Import Export Viz Car E.I.RL., quien solicita la inaplicabilidad del Decreto de Urgencia Nro. 079-2000, el Decreto Supremo Nro. 045-200-MTC y la Circular Nro. INTA-CR-124, normas que ponen límites a la importación e ingreso al país de los vehículos usados de carga y pasajeros. La Empresa sustenta la demanda en base a la afectación de sus derechos constitucionales a la libertad de empresa, a la libertad de contratación y a la libre competencia. Es así, que el Tribunal Constitucional se pronuncia al respecto de la aplicabilidad de las normas antes citadas, siendo que declara la demanda fundada en parte.
En el desarrollo del informe, se expone las normas en cuestión para comprender su contenido y sus modificaciones en el tiempo, un resumen de la sentencia del Tribunal Constitucional y un análisis de la misma en base a los puntos controvertidos.
This report presents the decision of the Constitutional Court in case No. 0510-2001-AA/TC, in which it ruled on the Amparo lawsuit filed by the company Import Export Viz Car E.I.R., requesting the inapplicability of Emergency Decree No. 079-2000, Supreme Decree No. 045-200-MTC and Circular No. INTA-CR-124 rules place limits on the importation and entry into the country of used cargo and passenger motor vehicles. The plaintiff supports its request based on the affectation of its constitutional rights to freedom of contract, freedom of enterprise, and free competition. Thus, the Constitutional Court ruled on the applicability of the aforementioned norms, declaring the claim to be partially founded. In the development of the report, the norms in question are exposed to understand their content and their modifications over time, a summary of the sentence of the Constitutional Court, and an analysis of the same based on the controversial points.
