The main objective of this study was to determine the factors that influenced the evolution of environmental law and extractive activities in Latin America, 2020. It was developed in accordance with the methodological guidelines of a socio-legal investigation, with a basic purpose, qualitative approach, design non-experimental cross-sectional phenomenological and descriptive correlational level or scope, using interview and documentary analysis as techniques, the instruments were the semi-structured interview guides and documentary analysis; The population was made up of environmental engineers, specialist lawyers from the Environmental Assessment and Enforcement Agency, and a teacher specializing in the matter from the Northern Private University. Non-probabilistic sampling was chosen for convenience, being made up of eight specialists and five Latin American regulations. The main results indicated that the existence of environmental regulations is inefficient in terms of its proper execution, exceeding the maximum permissible extremes, as well as a suitable control by the competent authorities. It was concluded that the environmental policy must be subject to an adequate analysis with good planning, which is oriented to new procedures such as regulatory compliance programs that identify the risks of extractive companies, reducing environmental pollution.
