La constitución política del Estado Peruano protege derechos fundamentales que permiten el desarrollo de la persona humana en la sociedad, cabe precisar que uno de los pilares fundamentales es el desarrollo profesional, la investigación científica, asimismo, la limitación y protección de los derechos conexos. El acceso a la información pública protegido por el habeas data es lo que nos cita y origina la presente causa, por cuanto Christan Paima Campos, interpone demanda de habeas data contra Electro oriente S.A. ante la negativa de brindarle la información para el desarrollo de una investigación de meritocracia, que fue negada en primera y segunda instancia, considerando que la demandada era una entidad sujeta al régimen privado por tanto solo correspondía solicitarle información bajo las tres características establecida en la ley de transparencia. Sin embargo, se describió en lo sustentado como fundamentos principales del máximo intérprete de la constitución, que la entidad demandada le era aplicable la ley de transparencia por cuanto era una empresa del estado, aplicándose el artículo 8 de la citada ley, declarándose fundada la demanda.
The present litigation deals with the contentious administrative lawsuit through which Martha Esther Reátegui Soria requested the restitution of the right to work and reinstatement to her job, because the Public Entity of the Provincial Municipality of Maynas arbitrarily fired her by preventing her from entering her work center as Promoter in the Glass of Milk Program. In the judgment of first and second instance issued by the A quo and the Ad quem respectively, they considered that there was no violation of the constitutional right to work because the plaintiff was under the rule of the CAS and one of the grounds for termination was the expiry of the hiring period and it was not necessary to hire her again. However, in the cassation procedure filed by the plaintiff, the First Chamber of Transitory Constitutional and Social Law of the Supreme Court of Justice of the Republic, declared the lawsuit founded in which it is established as decision-making grounds that it was appropriate to protect what was requested by the plaintiff because the right to work was violated and the distortion of the protected contract and the guiding principles of labor and constitutional law were not taken into account.
The political constitution of the Peruvian State protects fundamental rights that allow the development of the human person in society, it should be noted that one of the fundamental pillars is professional development, scientific research, as well as the limitation and protection of related rights. Access to public information protected by habeas data is what cites us and gives rise to this case, since Christan Paima Campos files a habeas data lawsuit against Electro Oriente S.A. Given the refusal to provide the information for the development of a meritocratic investigation, which was denied in the first and second instance, considering that the defendant was an entity subject to the private regime, therefore, it was only appropriate to request information under the three characteristics established in the law. of transparency. However, it was described in what was sustained as the main foundations of the highest interpreter of the constitution, that the defendant entity was applicable to the transparency law because it was a state company, applying article 8 of the aforementioned law, declaring the lawsuit founded.
