The purpose of this thesis was to establish the necessary appropriate regulation of human assisted reproductive techniques (ART) and the mandatory protocols for the study of donors and related users for proper medical diagnosis, fetal protection and pediatric protection. With the purpose of protecting the life, health and life project of the people who are born and will be born by means of these human assisted reproduction techniques (TERAS) supported by a suitable medical attention and with all the necessary tools so that they are given effectively. This thesis uses the qualitative methodology, because it will be investigated in an analytical and argumentative plane on jurisprudence and doctrine, as well as bibliographic material related or referring to what is dealt with in this document; not entering the field of statistics. The topics developed in this research work were the human assisted reproduction techniques (TERAS), the obligatory protocols of study of transferors and related users, the contracts and the TERAS, the Human Genetic Right, the Mapping of the Human Genome, the Right to Reproduction, to Life and Health, the Medical Diagnosis, the Fetal and Pediatric Development and the Right to the Life Project. Finally, the main conclusion reached was that it is necessary the appropriate regulation of human assisted reproductive techniques (ART) by means of service rental contracts and mandatory study protocols of the assignors and related users. Given that the lack of appropriate regulation exponentially increases the lack of protection of rights, the breach of duties and obligations, the production of civil, criminal and administrative conflicts, etc. This thesis defines that, in order to protect the life project of a much desired child, it is necessary to guarantee the protection of the child's health, both in the fetal and pediatric stages, since the first stages of life are vital to guarantee the existence of a full future.
