This research work has both legal and social nuances, the right to education is an enabling right that allows active participation in society, the State must guarantee access to education for all citizens, recognized by main international treaties such as the Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, and in this specific case, the Convention on the Rights of Persons with Disabilities. The part of the analysis of education policies that the State provides to people with disabilities and how they are informed about the right to education enshrined in art. 13 of the Political Constitution of the State, analysis carried out at the “San Juan de Dios” Special Basic Education Center. A bibliographic study was carried out and the analysis of interviews directed to professionals of different branches in relation to the subject in question was carried out. The document analysis file and the interview analysis file were used as instruments. The results show that there are political, economic and social barriers that hinder access to education for people with disabilities. The defense of the right to education must formalize through concrete control and operation actions exercised by the public powers, these must be, specialized legislation, inspection and control mechanisms, study plans for each educational modality, students' competences and correct way of evaluating them and finally the evaluation and qualification of teachers. Finally, education as a multiplier right is of utmost importance for the population with disabilities and how much it allows them to access opportunities and thus develop their life freely with a life project
