Title: La calificación registral de resoluciones judiciales en el sistema registral peruano.

Abstract: . The investigation was developed in the Registration Zone N ° X- Cusco Headquarters, where they had access to various titles that were registered under warning, as well as the interviews made to the Registrars in charge of the Land Registry, with whose information it was possible to verify the hypothesis raised at work. The main objective was to determine how to overcome the violation of the principle of legality due to the lack of registration of judicial decisions in the Peruvian Registry System; to thereby contribute to overcoming the violation of the principle of legality, by modifying the second paragraph of article N ° 2011 of the Civil Code. The methodology consisted of: performing a documentary analysis regarding resolutions issued by the Registry Court, in-depth interviews, documentary compilation and surveys contained in a questionnaire. The conclusion of the investigation is that it is necessary the existence of a clear and precise regulation that effectively regulates the registration of judicial decisions that are reflected in the concordance between the resolution of judicial jurisdiction and the titles already registered; and consequently have valid and perfect seats that guarantee a single legal security.

La investigación fue desarrollada en la Zona Registral N° X- Sede Cusco, lugar en donde se tuvo acceso a diversos títulos que fueron inscritos bajo apercibimiento, asimismo las entrevistas realizadas a los Registradores encargados del Registro de predios, con cuya información se logró comprobar la hipótesis planteada en el trabajo. El objetivo principal fue determinar cómo superar la vulneración del principio de legalidad por la ausencia de calificación registral de resoluciones judiciales en el Sistema Registral Peruano; para de esa manera aportar a superar la vulneración del principio de Legalidad, mediante la modificación del segundo párrafo del artículo N° 2011 del Código Civil. La metodología consistió en: realizar análisis documentario respecto de resoluciones emitidas por el Tribunal Registral, entrevistas en profundidad, recopilación documental y encuestas plasmadas en un cuestionario. La conclusión de la investigación es que es necesario la existencia de una normativa clara y precisa que regule de forma eficaz la inscripción de resoluciones judiciales que se vean reflejados en la concordancia entre la resolución de fuero judicial y los títulos ya inscritos; y en consecuencia tener asientos válidos y perfectos que garanticen una sola seguridad jurídica.
