The present investigation work, part of a concrete and objective fact, that is to say in the need to regulate the legal institute of the “consultation“, in the processes of recognition of de facto union in Peru, we understand that the consultation although not it is an impugnative resource, it is a Procedural Institute that allows the process to be elevated to the higher instance, with the purpose that a control of the due process and effective jurisdictional protection is maintained, in protection of the rights and obligations that derive from the judicial recognition of the union in fact, when the judgment rendered at first instance has not been appealed. Therefore, the present investigation intends to analyze the legal and factual arguments in favor of the consultation, in the process of recognition as a de facto union, to incorporate in article 359 of the Civil Code and 408 of the current Civil Procedure Code, a mandate express, to raise in consultation the sentences in the recognition of de facto union and that these have not been appealed. In the first chapter of our thesis, we will refer to the methodological aspects that are addressed in the work, in the second chapter we will deal with the theoretical framework, in which we develop background of the query, fundamental principles, challenges, procedural channels and union in fact; In the third chapter, we will refer to the methodological aspects; in the fourth chapter to the administrative aspects and in the final chapter, the proposal of legislative initiative to incorporate in Article 408 of the Civil Procedure Code, the obligation to raise in consultation with the higher instance, the sentence that was not challenged.
