The main objective of the investigation is to study the factors of insufficient judicial motivation of civil reparation in the crime of sexual rape of minors, established in article 173 of the Peruvian penal code; and for this, it was necessary to resort to the theoretical bases of reliable and valid sources to develop the topics of the due judicial motivation of judicial resolutions, civil reparation, the crime of sexual rape in underage victims. Likewise, six files of the Supreme Court had to be studied for the crime of rape of minors, cases from the Superior Court of Justice of Cusco, in which the maximum amount set by the Supreme Court, for concept of civil reparation in favor of the underage victim for the crime of sexual rape, regulated in article 173 of the Peruvian penal code, is S / 5,000.00 Soles and the minimum amount is S / 2,000.00 Soles; and, on average, the amount of S / 3,583.33 Soles is fixed for civil reparation in favor of the victim. Finally, the investigation was complemented by a survey of 56 experts in Criminal Law among lawyers, prosecutors and judges of the Judicial District of Cusco in 2020, having obtained positive responses to achieve the objectives set out in our investigation.
