The unconstitutionality of the collisionist thesis in the difficult cases of the Peruvian constitutional court: case Nº 00011-2013-AI / TC and case Nº 06712-2005-HC / TC. The present research is based on the current development of constitutional theory and fundamental rights specifically in the context of the conflict that arises when rights interact in a specific case hierarchizing a fundamental right over another, this understanding gainsay to the constitutional values of unity and coherence. In order to find a solution to the problem displayed, in the present investigation, I propose to make use of the harmonic thesis of fundamental rights. This thesis is framed in the type of confirmatory applied researches in whom I describe the different qualities of the investigation using series of data collection techniques and devices, specifically the analysis of documentary and doctrinal sources and constitutional jurisprudence. For the elaboration of the topic and fulfillment of the objectives the analysis of specific cases was carried out, which were used to identify the problem and the proposed a solution. Finally, it was possible to determine the unconstitutionality of the collisionist thesis in the difficult cases of the Constitutive Court and the application of the delimiting thesis as a solution, being impossible the limitation of the rights, and then the contradiction or confrontation of the same. Therefore, the content of fundamental rights is only one; a single constitutional content. We must always look for a harmonic interpretation that procures a single possible correct answer.
