The objective of this research is to formulate proposals for criteria to establish a Bilateral Agreement between Perú and Ecuador, for a joint contingency plan to respond to oil spills at sea, based on the Regional Agreements of the Permanent Commission of the South Pacific (CPPS) the performance of the response actions by the institutions was analyzed. Likewise, criterias were formulated to establish a national plan for the control of oil spills at sea. And political and legal criterias were identified for establishing a Bilateral Agreement between Perú and Ecuador for a joint contingency plan were identified. The type of research is qualitative, with the participation of 10 specialists between Peruvians and Ecuadorians. The collection technique was documentary analysis and interview. A document analysis guide and an interview guide were developed. The analysis of the interviews consisted in the identification of the main and important ideas, which allowed us to classify the information and then describe it in the results. It was concluded that in order to establish a Bilateral Agreement between Perú and Ecuador for the elaboration of a joint contingency plan in response to oil spills at sea, the legal criteria must be focused on the basis of the International Convention on Cooperation, Preparation and Struggle Against Hydrocarbon Pollution, 1990 (OPRC Agreement), taking into account the current regulatory framework of both countries regarding bilateral agreements that include Customs and Migration provisions in order to facilitate the entry of personnel and equipment to address the emergency situation and cope with possible incidents of pollution in the environment. The political criteria, must be aligned mainly to the environmental policy of each country, take into account the established maritime limits, this issue should be part of the bilateral meetings and should consider and implement binational internal control functions.
