This research work is focused in describing the implications that the National Port System Law generates. How does it affect the Maritime Authority competencies (through the General Directorate of Coastguard and Captaincies – DICAPI) and to the National Defense, in what concerns the granting of aquatic areas concessions, transferring these competencies to the National Port Authority (APN) would cause not to collect the major resources necessaries for the administration and accomplishment of the Maritime Authority mission, which would lead to a provide an appropriate security service for human life at sea or to be able to attend to some search, rescue, pollution, illegal activities emergencies among the principals, as long as the State does not cover the budgetary deficit generated by the transference of such competencies, likewise an unmeasurable grant or badly evaluated concession of aquatic areas could affect the areas aimed for National Defense; reason why the National Port System and its respective regulation must be modified in order to set clearly and accurately the functions and competencies of the National, Regional Port Authorities; and the National Maritime Authority, based on technical criteria.
